I was diagnosed with a fracture of the 5th metatarsel 2 years ago. I was put in a cast within days and had to have it removed by the emergency room due to the worst pain I have ever felt. I then returned to my Orthopaedic Surgeon for him to simply put me in a air cast and dismissed it as the cast was put on too tight. The swelling of my ankel area was that of almost a baseball. It was black,blue,purple and yellow. I then waiting for it to heal and it it never seemed to get better. I was sent to PT and this didn't seem to help much but just put me in more pain. I returned to my Orthopaedic Surgeon several times complaining of pain,brusing and swelling. He would take more xrays and tell me the fracture was heeling fine. I was not willing to accept this and the last time I seen him him he told me that if I continue to have issues and I wanted he would order an MRI.
So at this point I was not very happy with him so I went to see a Sports and Medicine foot specialist. She really seems to know what she is talking about and sent me in for an MRI. I got the mRI to find out that I did indded fracure my 5th metatarsel but I also completelt tore my PERONEUS BREVIS TENDON and have a 4 cm retraction and some other fractures that were all missed with the Orthopaedic Surgeon. So she tells me that since it has been two years she does not want top do surgery but I will need to have a custom brace made for me to wear the rest of my life.
Does this sound correct to have to wear a brace forvever because suregery cannot be performed?? What about tendon jacket or tendon grafting??
Can I go back on this Orthopaedic Surgeon for misdiagnosis or malpractice??
